Terms & Conditions
1. Introduction and Acceptance
These Terms and Conditions ("Terms") govern your use of the Loquemea website, social media channels and all products and services offered under the Loquemea brand (together, the "Services"). By accessing our website, purchasing a product or booking a service, you confirm that you have read, understood and agreed to these Terms. If you do not agree, please do not use our Services.
2. Our Services
Loquemea offers three main lines of activity, available in Spanish, English and Italian: Digital products: checklists and e-books for hospitality and restaurant businesses ("Digital Products"). Language tutoring: one-to-one lessons in English, Spanish and Italian, offered under the Loquemea name ("Tutoring"). Web design: design and development of websites for clients ("Web Design Services"). We may add, change or withdraw Services at any time. Descriptions of Services on our website are for general information and may be updated without notice
3. Eligibility
You must be at least 18 years old, or the age of legal majority in your country, to purchase from us. Tutoring for minors must be booked and accepted by a parent or legal guardian, who is responsible for the minor's compliance with these Terms.
4. Orders, Prices and Payment
All prices are shown in Euros and include applicable taxes (such as VAT/IGIC) unless stated otherwise. Payment is due at the time of purchase or booking, unless a different schedule is agreed in writing (for example, milestone payments for Web Design Services). Payments are processed by third-party payment providers. We do not store your full card details. We may correct pricing errors and may refuse or cancel an order where a Service is unavailable or we suspect fraud. Overdue invoices for agreed Services may result in work being paused until payment is received.
5. Digital Products (Checklists and E-books)
5.1 Delivery. Digital Products are delivered electronically, by download link or email, after payment is confirmed. You are responsible for providing a correct email address and for saving the files you receive.
5.2 Licence. When you buy a Digital Product, we grant you a personal, non-exclusive, non-transferable licence to use it for your own business or personal use. Unless the product states otherwise, you may adapt checklists for use within your own establishment(s), but you may not resell, redistribute, share publicly, upload to file-sharing sites or pass off the content as your own.
5.3 No professional advice. Our checklists and e-books are general guidance for hospitality operations. They are not legal, health and safety, tax or other professional advice. You remain responsible for complying with the laws, licences and regulations that apply to your business.
5.4 Results. We do not guarantee any particular commercial result, increase in revenue, or outcome from using our Digital Products.
6. Tutoring Services
6.1 Booking. Lessons are booked through the method indicated on our website or by direct agreement. A lesson is confirmed once we acknowledge your booking and, where required, payment is received.
6.2 Cancellations and rescheduling. You may cancel or reschedule a lesson free of charge with at least [72] hours' notice. Cancellations made with less notice, and missed lessons ("no-shows"), may be charged in full. If we need to cancel, we will offer you a replacement time or a refund for the lesson affected.
6.3 Lesson packs. Prepaid packs of lessons are valid for 3 months from purchase, after which unused lessons expire unless agreed otherwise.
6.4 Online lessons. You are responsible for having a suitable device and a stable internet connection. Lessons interrupted by problems on your side are not eligible for a refund or make-up session.
6.5 Conduct and recordings. We expect respectful behaviour from both sides. Lessons will not be recorded without the consent of everyone taking part. Lesson materials we provide are for your personal use only and may not be shared or resold.
6.6 No guarantee of results. Progress in language learning depends on many factors, including your own effort and practice. We do not guarantee specific results, exam outcomes or fluency levels.
7. Web Design Services
7.1 Scope and quotation. The scope, deliverables, timeline and price of each project will be set out in a written quote, proposal or agreement. Work outside that scope will be quoted separately.
7.2 Client responsibilities. You agree to provide content (text, images, logos, etc.), feedback and approvals in a timely manner. Delays on your side may affect delivery dates and may lead to additional charges.
7.3 Revisions. The number of revision rounds included will be stated in the quote. Further revisions may be charged at our standard rate.
7.4 Your content. You confirm that you own, or have permission to use, all material you provide, and that it does not infringe any third party's rights or any law. You will indemnify us against claims arising from material you supply.
7.5 Ownership. Upon full payment, you receive ownership of, or a licence to use, the final website design and custom content created specifically for you. We retain ownership of our pre-existing tools, templates, code and know-how, and of any third-party components (themes, plugins, fonts, stock images), which remain subject to their own licences.
7.6 Third-party costs. Hosting, domain names, premium plugins, stock media and similar items are not included unless stated in the quote.
7.7 Portfolio. Unless you tell us otherwise in writing, we may display the finished work in our portfolio and marketing materials.
7.8 Maintenance and support. After launch, ongoing maintenance, updates, security and support are only included if agreed in writing. We do not guarantee uninterrupted or error-free operation of any website, or particular search engine rankings or traffic.
8. Refunds and Right of Withdrawal
- Digital Products: because Digital Products are delivered immediately, by purchasing you agree that delivery begins right away and, where the law allows, you lose any right of withdrawal once the download or access has been provided. If a file is defective or you did not receive it, contact us and we will fix the problem or refund you.
- Tutoring: unused, prepaid lessons may be refunded on request within 15 days of purchase, minus any lessons already delivered. Lessons already taken are non-refundable.
- Web Design Services: deposits are non-refundable once work has started. Refunds for work in progress, if any, will be calculated according to the work completed up to the date of cancellation.
Nothing in these Terms limits any rights you have as a consumer under mandatory law.
9. Intellectual Property
All content on our website and in our products, including text, logos, graphics, names (Loquemea and related marks), layouts, checklists, e-books and teaching materials, is owned by us or our licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, modify or exploit it without our prior written permission, except as expressly allowed in these Terms.
10. Acceptable Use
You agree not to:
- use the Services for any unlawful or fraudulent purpose;
- attempt to gain unauthorised access to our website, systems or accounts;
- upload viruses or harmful code;
- harass, abuse or threaten us or other users;
- copy or scrape our website or materials without permission.
We may suspend or terminate access to the Services if you breach these Terms.
11. Disclaimers and Limitation of Liability
The Services are provided "as is" and "as available". To the fullest extent permitted by law:
- we make no warranties, express or implied, other than those that cannot be excluded by law;
- we are not liable for indirect, incidental or consequential losses, including loss of profit, revenue, data or business opportunity;
- our total liability to you in connection with any Service will not exceed the amount you paid us for that Service.
Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded under applicable law.
12. Privacy and Data Protection
We collect and use personal data as described in our Privacy Policy [LINK].
By using the Services you acknowledge that your data will be processed in accordance with that policy and applicable data protection laws.
Our website may use cookies, as explained in our Cookie Policy [LINK].
13. Third-Party Links and Services
Our website and social media channels may contain links to third-party sites, and we may rely on third-party tools (such as payment processors, video-call platforms and hosting providers). We are not responsible for the content, policies or practices of third parties.
14. Force Majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including illness, technical failures, power or internet outages, natural disasters or government actions.
15. Changes to These Terms
We may update these Terms from time to time. The version published on our website at the time of your purchase or booking applies to that transaction. Continued use of the Services after changes are posted means you accept the updated Terms.
16. General
- Entire agreement: these Terms, together with any written quote or agreement for a specific Service, form the entire agreement between you and us.
- Severability: if any provision is found to be unenforceable, the rest remains in effect.
- No waiver: failure to enforce a provision is not a waiver of our rights.
- Assignment: you may not transfer your rights under these Terms without our consent.
- Language: these Terms may also be provided in Spanish and Italian. If there is any inconsistency, the Spanish and Italian version prevails.
17. Governing Law and Disputes
These Terms are governed by the Spanish laws. Any dispute will be submitted to the courts of Santa Cruz de Tenerife, without prejudice to any mandatory consumer rights you may have to bring proceedings in the courts of your place of residence. Before starting formal proceedings, we encourage you to contact us so we can try to resolve the matter amicably.
